Asbestosis and the Legal implications

December 20th, 2008 by admin | No Comments | Filed in Uncategorized

A chronic medical condition, which affects the tissue of the lungs, is known as asbestosis. Mine workers and several other professionals suffers from this disease, which occurs due to heavy exposure to asbestos over a long period. Shortness of breath is the most common complaint from those affected by asbestosis and ultimately they end with various types of cancer of the lung.

During the early part of this century, the link between cancer, exposure to asbestos and asbestosis was established and the governments enforced strict safety measures. In 1929, asbestos manufacturers faced the first lawsuit. Afterwards there was a deluge of lawsuits against employers and manufacturing for neglecting the safety regulations.

According to various allegations, training and information regarding detection, removal, diseases, dangers and other issues connected with asbestos are not provided to managers and employers. To implement the wide range of regulations properly, managers and employers are pleading for relevant information and training.

From the sheer magnitude of lawsuits and complaints by people suffering from asbestosis, the liability reached billions of dollars. Many court cases fought over the issue of method and amount of compensation and their allocation. In June 1982, James Cavett, a retired boilermaker was awarded a record compensation of 2.3 million US dollars as compensation and 1.5 million US dollars as punitive damages.

In the history of the United States, one of the most expensive and longest mass torts is asbestos litigation. Currently there are 600000 claimants and 6000 defendants connected with asbestos litigation. According to the current trends, there will be a sizeable increase in the number of people being diagnosed with asbestosis during the next decade.

There was a heavy toll on industry and insurance due to the litigation connected with asbestosis and asbestos. Unfortunately, to obtain a just compensation against the employers and manufacturers of asbestos, litigation is the only recourse.

By employing a lawyer experienced in and asbestosis, substantial compensation can be obtained by individuals exposed to asbestos and subsequently suffering from asbestos related diseases.

In the United States, is known to be caused only by exposure to asbestos and by proving the exposure, which subsequently led to the disease, legal compensation can be easily won. At the same time, it should be noted that the asbestos industry fights these cases by engaging some of the best legal brain available. They not only try to deny compensation but also drag and delay the process of justice to the asbestosis victims.

The In Depth Study of Mesothelioma Part 2 - Peritoneal Mesothelioma

December 20th, 2008 by admin | No Comments | Filed in Uncategorized

If you’ve not read my first part about the three main branches of , then that’s fine. I would recommend you find it and read it, but I am writing these in such a manner as have them stand alone. This article is on the second common type of cancer.

The second common type of is peritoneal . Peritoneal is a type of cancer that affects the thin cell membrane around the abdomen. This part of the body is called the peritoneum. Peritoneal Mesothelioma is the second most common type of Mesothelioma cases. The percent of which is about 10% of the total amount of asbestos related cancers.

Peritoneal is unfortunately terminal, though there is the possibility of slowing the progress of the cancer in order to prolong life. Although this is a more rare form of peritoneal claims many lives each year and thus far there is no cure for this disease. Peritoneal is just another rare and aggressive asbestos-related malignancy.

As told in my previous description of pleural , the mineral called asbestos is the main cause of most cases. Although some cases of peritoneal have also been reported following exposure to erionite and Thorotrast. The majority of patients were exposed to asbestos.

Although at this time incurable, treatment options are currently the same as other cases: radiation therapy, , surgery, and constant draining of fluid in the body. Since treatment for peritoneal varies so much, and is dependent upon a number of factors, it is recommended that research be done to find the best option for treatment.

In conclusion, I would like to add that the finding of malignant such as peritoneal have increased dramatically over the last 20 years, but despite this, is still a comparatively rare form of cancer, and should not be feared. But take fair warning that you guard yourself if you’re working with any asbestos related products, and know your rights if you are ill prepared or warned.

Traditional Mesothelioma Treatment

December 20th, 2008 by admin | No Comments | Filed in Uncategorized

Traditional treatments are the standard treatments for malignant , which is a cancerous disease affecting the mesothelial cells in tissues of the human body. Treatment methods of diverge due to a number of factors, such as the location of the cancer cell, the stage of the disease, and a patient’s personal choices. In general, traditional treatment includes surgery, and radiation therapy, or different combinations of these three treatments.

Surgery or surgical treatment is employed to either remove the cancer from the affected organ or alleviate pain. Sometimes, it may be impossible to remove all parts over which the affliction has spread; however surgical intervention may help in reducing pain. Two major types of surgical treatments include “pneumonectomy” and “palliative procedures.”

Pneumonectomy involves the surgical removal of a lung. This method comes in two varieties, “traditional pneumonectomy” in which the diseased lung is removed, and “extrapleural pneumonectomy” wherein the afflicted lung as well as part of the pericardium, diaphragm or parietal pleura on the same side of the chest, are removed.

In palliative procedures, treatment used does not heal , but eases pain and controls symptoms. “Thoracentisis” and “pleurectomy/decortication” are among the various palliative procedures. In thoracentisis, a needle is put into the chest cavity, either to drain fluid for diagnosis, or to drain fluid to relieve pain. Pleurectomy/decortication removes the pleura so as to lessen pain or prevent the recurrence of pleural effusion.

Chemotherapy is another important traditional treatment used to kill cancer cells by injecting medicines intravenously into the ailed areas. This method also involves the use of drugs to keep cancer cells from multiplying. Side effects can be quite severe in this treatment because may even destroy healthy cell in addition to the cancer cells. Nausea, vomiting, fatigue, hair loss, constipation, decreased appetite and mouth sores are some of its side effects.

Radiation treatment (radiation therapy or radiotherapy) uses high-energy rays (like x-rays) to damage cancer cells in a localized area. Although healthy cells may also be affected, they can repair themselves more effectively. The side effects of radiotherapy as a traditional treatment include fatigue, hair loss, skin irritation, nausea and difficult breathing.

Strategies for Prevention of Prostate Cancer

December 20th, 2008 by admin | No Comments | Filed in Uncategorized

Prostate cancer is a very common disease among males in the United State. If
is excluded, is the most common type of cancer
among men living in the United States. Prostate cancer may have much
variation in the stage and extend of disease at presentation and in many
people the cancer might linger for a long period of time without causing any
significant problems to the person. Because of this reason, number of men
who would die from is much smaller than the number of men
who would be diagnosed with .

There are several factors that might increase the risk of developing
and by modifying some of these factors it might be possible
to decrease the risk of this disease in some people. Also some attempts at
modification of the external environment may also reduce the risk of
developing .

Chemoprevention: The term chemoprevention is generally referred to the use
of synthetic drugs, vitamins, or other agents to prevent the development of
a cancer. Several drugs have shown potential benefits as
prevention agents. These drugs are still in early stages of clinical trials
and much more studies are required to authoritative state that these drugs
indeed prevent the development of . Some of the drugs which
are in active clinical trial for prevention of include,
difluoromethylornithine (DFMO), isoflavonoids, selinum, vitamin D, vitamin E
and lycopene.

Changes in diet and life-style: Diets rich in animal fats might increase the
risk of developing , so theoretically decreasing the amount
of animal fat in the diet might decrease the risk of developing prostate
cancer. Active clinical trials are ongoing focusing on the issues of dietary
modification as a way of prevention. Some of the ongoing
studies might answer the question if food low in animal fats and high in
fruits and vegetables would ultimately decrease the risk of .
Some recent studies have shown that dietary products and diets rich in
calcium might increase the risk of developing . Future
studies may answer the question with regard to benefit of dietary
modification in the context of .

Hormonal prevention: Prostate cancer is treated with suppression of male
hormone testosterone. In theory drugs that would cause a decrease in the
testosterone levels might decrease the risk of development.
Studies are undergoing using some of the male hormone blocking drugs to see
if this strategy would be effective in prevention. An
example of one such drug is finasteride, which causes a decrease in the
amount of male hormone (testosterone) produced by the body.

In summary there are several strategies that might be effectively used to
prevent the development of . Some of these strategies are
more promising than other ones and only more work and research would
ultimately show us, which of these strategies are better and if so if these
strategies could be used in combination.
